2. Acceptance of the Terms
Accessing or using the Service implies that the user fully accepts these Terms, the Privacy Policy and the Cookie Policy. If you do not agree, you must refrain from using the Service.
The user declares that they are at least 18 years old or have sufficient legal capacity to contract, and act on their own behalf or on behalf of a company with legal capacity.
3. Description of the Service and its essential limitations
Alertia Risk is a SaaS platform for monitoring and global risk intelligence that provides information on critical events in real time. The Service includes, among other functionalities: event alerts, interactive maps, country risk indicators, geofencing, personnel security and artificial intelligence assistant.
The user expressly acknowledges and accepts the following inherent limitations of the Service:
3.1 Exclusive informative nature
Alertia Risk is an informational support tool. The information provided is for guidance only and does not constitute professional security, legal, medical, financial or operational advice in any case. Alertia Risk is not an emergency service, nor does it replace State security forces or evacuation or emergency response services. In the event of any real and immediate danger, the user must contact the competent authorities (112 or equivalent in each country).
3.2 No personal security guarantee
Alertia Risk does not guarantee, under any circumstances, the physical or personal safety of users, employees or other persons. The Service provides informational alerts, but cannot prevent, avoid or manage risk situations. Responsibility for decisions made based on the information provided lies solely with the user.
3.3 Service availability
Alertia Risk does not guarantee uninterrupted availability of the Service. The platform may experience interruptions, technical failures, maintenance periods or failures caused by factors beyond the control of Alertia Risk, including problems with external providers, infrastructure failures or force majeure events. Alertia Risk will make reasonable efforts to minimise interruptions, but assumes no liability for any damages arising from the lack of availability of the Service.
3.4 Source coverage and event detection
Alertia Risk monitors a set of information sources in continuous expansion. However, it does not guarantee the detection of all risk events that may occur worldwide, nor exhaustive coverage of all regions, countries or languages. There may be events that are not detected, not classified or not included in the Service. Service coverage may vary and be modified without prior notice.
3.5 Alert and notification delivery
Alertia Risk does not guarantee the effective, timely or uninterrupted delivery of alerts and notifications, whether via email, Telegram, WhatsApp, push or other channels. Notification delivery depends on external factors beyond the control of Alertia Risk, including telecommunications providers, third-party messaging platforms, user connectivity and device configuration. The user should not rely exclusively on Alertia Risk notifications as the sole source of information in risk situations.
3.6 Veracity and verification of information
The information published on Alertia Risk comes from multiple external sources and is processed by automatic systems and artificial intelligence. Alertia Risk applies verification processes, but cannot guarantee the accuracy, veracity, completeness or updating of all published events. Some events may contain errors, inaccuracies, incomplete data or unverified information at the time of publication. Events marked as 'unverified' have not passed the cross-verification process and should be treated with particular caution. Alertia Risk reserves the right to modify, correct, update or delete any published event or alert at any time and without prior notice.
3.7 Modification and updating of alerts
Events and alerts published may be modified, updated, corrected or deleted at any time as new information becomes available. Alertia Risk assumes no liability for decisions made based on information that has been subsequently modified or deleted.
3.8 Service in continuous development
Alertia Risk is a service in active development phase. The functionalities, data sources, geographic coverage, classification algorithms and system performance may change, expand or be reduced without prior notice. Some functionalities may not be temporarily available or may be modified during the user's subscription period.
4. Registration and user account
To access certain functionalities, the user must create an account providing truthful, up-to-date and complete information. The user is responsible for maintaining the confidentiality of their credentials and for all activities carried out from their account.
Alertia Risk reserves the right to suspend or cancel accounts that breach these Terms or misuse the Service.
5. Obligations and permitted use
The user undertakes to use the Service lawfully and in accordance with these Terms. The following is expressly prohibited:
- Using the Service for illegal, fraudulent or deceptive purposes
- Attempting to access systems, servers or data without authorisation
- Introducing malware, bots, scrapers or unauthorised automated tools
- Copying, reselling, sublicensing or redistributing the Service, data or alerts without express written authorisation
- Using Alertia Risk to generate disinformation or cause harm to third parties
- Making critical security decisions based solely on information provided by the Service without cross-checking with additional sources and competent authorities
6. Intellectual property
All rights to the Service, including software, databases, maps, alerts, analyses, designs, trademarks and content, belong to Alertia Risk or its licensors. The user receives a limited, non-exclusive, non-transferable and revocable licence to use the Service in accordance with these Terms.
7. Plans, payments and subscriptions
7.1 Free access for NGOs: Alertia Risk offers free access to non-profit organisations dedicated to humanitarian action, development or missions in risk contexts, subject to verification and acceptance by Alertia Risk.
7.2 Free trial: Alertia Risk may offer free trials for a limited time. Upon completion, access to paid functionalities may be suspended until a paid plan is activated.
7.3 Subscriptions and payments: Subscriptions are billed periodically (monthly or annually) and renew automatically unless previously cancelled. No refunds will be made for billing periods already started, except as required by law. Alertia Risk reserves the right to modify prices or plans with reasonable advance notice.
8. Disclaimer of warranties
The Service is provided 'AS IS' and 'AS AVAILABLE', without warranties of any kind, express or implied. Alertia Risk expressly excludes any warranty of:
- Availability, continuity or uninterrupted operation of the Service
- Accuracy, completeness, veracity or updating of data, events or alerts
- Effective and timely delivery of notifications
- Suitability of the Service for the user's specific needs
- Absence of errors, interruptions or technical failures
- Prevention of damage, losses or risk situations
9. Limitation of liability
To the maximum extent permitted by applicable Spanish law, Alertia Risk shall not be liable for:
- Direct, indirect, incidental, special or consequential damages
- Loss of profits, business opportunities, data or information
- Decisions made by the user based on Service information
- Interruptions, errors, failures or unavailability of the Service
- Personal, physical or material damages arising from the use or non-use of the Service
- Failures in alert or notification delivery
- Inaccuracy, omission or delay in information provided
- Actions or omissions of third-party information source providers
The user expressly acknowledges and accepts that Alertia Risk is an informational support tool for decision-making, and that in no case does it replace the user's professional judgement, emergency services or competent authorities. Use of the Service is at the user's sole risk.
In no event shall Alertia Risk's total liability arising from use of the Service exceed the amount paid by the user in the three months prior to the event giving rise to the claim.
10. Force majeure
Alertia Risk shall not be liable for failure to comply with its obligations when such failure is a consequence of causes beyond its reasonable control, including without limitation: natural disasters, armed conflicts, widespread telecommunications failures, government decisions, failures of external suppliers or any other force majeure circumstance.
11. Third-party services
The Service may integrate or link to third-party services. Alertia Risk does not control or is responsible for the services, content, availability or policies of such third parties.
12. Modifications to the Service and the Terms
Alertia Risk may modify these Terms, the Service, its functionalities or its prices at any time. Relevant modifications will be communicated by email or by notice on the platform with reasonable advance notice. Continued use of the Service after the publication of changes implies acceptance of the new Terms.
13. Applicable law and jurisdiction
These Terms are governed by Spanish law. Any dispute shall be submitted to the courts and tribunals of Madrid (Spain), unless applicable law provides otherwise.
